Sri Raghavendra Gho Samrakshana Trust is a trust incorporated in India under its the Indian Trust Act, 1882, having its registered office at Mutt streeet, Indian Bank Colony, Chennai - 600053, Tamil Nadu, India.
Sri Raghavendra Gho Samrakshana Trust, along with its subsidiaries and affiliates is hereinafter referred to as “Trust”.
The Trust Website is in compliance with various Indian IT Regulations (“Regulation”) is provided at Http://www.prasannaguru.org Website (“Website”). The Website is an online information and donation portal applicable only for specified Trust products, services provided by Trust & its affiliates to you (“User”), access to which is subject to terms and conditions set forth below (“Terms of Use”).
The Terms of Use (‘Agreement’) constitutes a binding contract between you, the User, and Trust & affiliates with regard to the services provided under the Website.
1. Purpose of Terms of Use.
1.1. The purpose of the Terms of Use is to govern the access and use of information on Trust & Its affiliates services (hereinafter referred to as “Information”) in compliance with the Regulation .
2. Registering on the Website
2.1. Information may be accessed on this Website, by signing up and filling a registration form. The privacy of the data included in the registration form shall be governed by Trust’s Privacy Policy (“Privacy Policy”). The Privacy Policy can be found at http://prasannaguru.org/policies.html.
2.2. All information filled into the registration form should be complete and accurate. In case of any discrepancy or suspected discrepancy Trust shall be entitled to cancel the registration.
2.3. Upon successful registration the User shall be provided a user name and password through which the User can access Information on the Website.
2.4. The User alone shall be liable for the security of its user name and password and access to the Website though the use of the same.
Registering on the Website3. Access to Information and Responsibilities of the User
3.1. The Information has been provided for the sole and exclusive purpose of User’s internal use, and Trust does not authorize any other use of the Information.
3.2. In accessing and using the Information, the User warrants and undertakes the following:
To not allow access to the Information and/or the Website to any third parties.
To not use the Website in a manner that obstructs, disturbs or prevents its use or access by other Users.
To not use the Website or Information without authorization or in any illegal or fraudulent manner.
3.3. In the event the User’s access or use of the Website is in, or is suspected to be in, contravention to these Terms of Use or any law, rule or regulation for the time being in force, Trust shall be fully entitled to revoke, suspend, limit, or restrict, the access to the Website by the User without any notice or refund, or obligation to pay any compensation.
3.4. In the event the User allows or fails to prevent access, or transfers Information, in whole or in part, to any third parties not duly authorized to access the Information or the Website, then Trust will be at liberty to invoke required legal action against the User and any such third party.
4. Disclaimer and Limitation of Liability
4.1. This Website is available internationally and may contain references or Information about products and services which are not available or are prohibited in the User’s country. This does not imply that all such products or services are or shall be made available in the User’s country or that the User may lawfully use them. It shall be the responsibility of the User to ensure compliance with the applicable laws and regulations and Trust shall not be liable for contravention of such laws or regulations by the User. Trust also reserves the right without prior notice to discontinue services at any time without incurring any obligations.
4.2. The Information has been made available exclusively for information purposes only. Trust cannot be held responsible for any for using Information.
4.3. Trust shall also not be liable for any consequences of the use of the Information provided on the Website by the User and the User shall indemnify Trust against any claims or actions arising from User’s act or omission regarding the use of Information or Website, or due to User’s breach of these Terms of Use.
4.4. Trust does not and cannot guarantee or warrant that any material, files, or Information accessed or downloaded though the Website shall be free from viruses, malware, or any other destructive or corrupting properties. It shall be the responsibility of the User to take the necessary measures for ensuring accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.
4.5. The Website may not be available due to maintenance, mechanical issues, telecommunication issues, software and hardware issues and third-party vendor failures (hereinafter referred to as ‘Downtime’). As Trust may not be able to predict or control such Downtime thus Trust is not liable for any inconvenience that the User may face due to the Downtime issues.
5. Updates and Modifications
5.1. Trust is under no obligation to update the Information at any particular intervals; however it reserves the right to modify or update the Information or the Website at such time and in such manner as it deems necessary in its sole discretion. Trust may also modify or update these Terms of use at any time without giving any notice of it. It shall be the responsibility of the User to visit the Website regularly to keep itself apprised on any updates in the Information, Website or the conditions of its use.
6. Miscellaneous
6.1. Failure or delay in asserting any rights or remedies shall not be construed a waiver of such rights or remedies. Any waiver shall only be effective when stated in writing and signed by the party waiving its rights.
6.2. The unenforceability or invalidity or any provisions of this Terms of Use shall not affect the remaining provisions which shall continue to remain in full force and effect.
6.3. The User cannot transfer or assign any of its rights or obligations under these Terms of Use.
6.4. Trust shall not be held responsible for non-performance of its obligations under these Terms of Use if such failure arises due to a force majeure event like strikes, any restriction or prohibition by law or legal authorities, breakdown of computer or telecommunication systems or servers, or any other cause beyond the reasonable control of Trust.
6.5. These Terms of Use shall be governed by and construed in accordance with the laws of India, without regards to its conflict of law rules, and the Courts of Madras shall have exclusive jurisdiction in any dispute or matter arising out of these Terms of Use.
6.6. The Article and / or Section headings herein are used for convenience of reference only, and shall not be deemed a part of the Agreement for the purpose of interpretation.
7. Refund Policy
7.1. You may request to refund the amount transferred in case of failed transactions or double realization of account for the same amount, the total deducted amount will be refunded. This is subject to the amount cleared by the payment gateway partner and realization of the same to the Trust Account.
